Draft Caddie Terms of Service

These Terms of Service (“Terms”) govern your use of draftcaddie.net and any associated services (the “Service”). The Service is operated from Texas, United States.
By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What the Service is
Draft Caddie is a software tool that helps groups of friends run fantasy-style sports pools — primarily PGA golf tournaments. The Service provides drafting, scoring, leaderboard, and communication features. It is a tool. It is not a betting platform, a sportsbook, or a gambling operator.
2. No gambling
The Service does not operate, host, broker, or facilitate any gambling activity. We do not collect, hold, transfer, or distribute entry fees, prizes, buy-ins, or any other money between users.
Any money exchanged between members of a pool is handled entirely offline, directly between those members, outside the Service. We have no visibility into such arrangements and accept no responsibility for them.
You are solely responsible for ensuring that any offline arrangements you make with your group comply with the laws of your jurisdiction. If you are uncertain whether a private pool is permitted where you live, do not include money in it.
We charge fees only for access to the Service software (creating pools and unlocking features). Our fees are in no way related to wagering, prize pools, or pooled buy-ins.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using it, you represent that you meet this requirement.
4. Your account
You create an account using a valid email address and a one-time sign-in code. You are responsible for safeguarding access to your email account, since access to your email grants access to your Service account. You agree not to share your account or impersonate another person.
5. Acceptable use
You agree not to:
- Use the Service to operate, broker, or facilitate any commercial gambling, sportsbook, daily fantasy operation, or pari-mutuel scheme.
- Harass, threaten, or defame other users in pool chat, feedback, or any text fields.
- Attempt to access another user’s account, scrape the Service in bulk, reverse-engineer the Service, or interfere with its operation.
- Use the Service for any unlawful purpose, or in any way that violates the rights of others.
We may suspend or terminate your access at any time for violations of these Terms.
6. Pool rules and commissioner authority
Each pool has a commissioner — the person who created it. The commissioner sets the pool’s rules within the options the Service exposes (draft format, roster size, scoring options, draft timing, and similar) and may make adjustments such as score corrections or manual overrides. By joining a pool, you agree to the commissioner’s authority within that pool. Disputes about pool rules are resolved by the commissioner. We are not arbiters of pool-level disputes.
7. Draft and pick rules
- Picks are final once committed. The Service requires a two-step confirmation; once confirmed, a pick can only be changed by the commissioner.
- If you fail to make a pick before your turn expires, the Service may automatically pick the next-best available player based on your saved queue or world ranking.
- If a drafted player withdraws from a tournament, that player remains on your team for that pool. The Service applies the configured missed-cut or withdrawal penalty for any rounds not played. No replacement pick is granted.
8. Scoring and data
The Service draws live tournament data from third-party sources, including ESPN’s public golf endpoints. We make a reasonable effort to reflect accurate scores in real time, but we cannot guarantee that third-party data is complete, timely, or error-free. Commissioners may manually correct scores in their pools. Final results are subject to commissioner verification.
9. Fees
During the current beta, pool creation is free. When fees are introduced, the price and scope will be clearly disclosed at the point of purchase. Fees, once paid, are non-refundable except where required by law. Fees grant access to software features only and are unrelated to any offline money among pool members.
10. Intellectual property
The Service, including its software, design, content, and marks, is owned by Draft Caddie or its licensors. You may use the Service for its intended purpose only. You may not copy, redistribute, or create derivative works from any part of the Service without our written permission.
11. Third-party content
Player names, tournament names, and statistics displayed in the Service may include marks and data owned by third parties (the PGA Tour, tournament organizers, ESPN, and others). We make no claim to any such third-party intellectual property. We have no affiliation with the PGA Tour, the Masters, the USGA, the R&A, or any tournament organizer.
12. Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE AT ALL TIMES.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSSES ARISING FROM THIRD-PARTY DATA OR OFFLINE ARRANGEMENTS BETWEEN POOL MEMBERS.
14. Indemnification
You agree to indemnify and hold harmless Draft Caddie from any claims, losses, or expenses arising out of (a) your use of the Service, (b) your violation of these Terms, or (c) any offline money arrangement among pool members in a pool you participated in.
15. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising out of or relating to the Service or these Terms will be resolved in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.
YOU AND DRAFT CADDIE EACH WAIVE THE RIGHT TO A JURY TRIAL. DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS — YOU MAY NOT BRING A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.
16. Changes
We may revise these Terms from time to time. The “Last updated” date above will reflect the latest revision. Continued use of the Service after a revision constitutes acceptance of the revised Terms.
